A report by the U.S. Citizenship and Immigration Services that found evidence of forged documents, fake degrees and shell companies being used in H-1B applications will likely lead to increased scrutiny of the visa petitions if the USCIS implements some of the steps it is now considering.
A USCIS spokesman said today that the agency is weighing a series of reforms to the H-1B application process, including the use of “independent open-source data” to obtain information about visa seekers or the companies that file the petitions on their behalf. For instance, USCIS officials could check petitioning companies against commercially available records to make sure that they are legitimate businesses.

The USCIS is also looking at implementing a risk assessment program for applications “based on objective criteria relating to fraud indicators,” the spokesman said. That would enable the agency to give greater scrutiny to H-1B petitions that raise flags during the review process.

This may come as a surprise to most, but the H1B visa system was started as a means of luring promising intellectuals to the US and encouraging them to stay (i.e. Green Card) and become a mainstream member of society (in other words, the American dream).

The way the H1B is currently used is entirely different and I am predicting a major change in both H1B and L1 visas soon – probably shortly after the administration changes.

I doubt anything will change as both Obama and McCain plan to increase the number of H-1’s. They may hike the, already high, fees under the pretense that they need to do background checks. They increased the fees a couple of years ago for this and nothing changed…

Agree – The cap on H1B will definitely increase – I’m predicting changes in the way these are handed out though. After all both candidates have those “contributions” to their election funds to consider.
