What Do You Think?

I just emailed Labnol on some issue ..and recieved this tip..but..I have seen other cool websites like insideorkut.com using it with no worries.

Will i be sued? (lol) But i am a kid … :P

Not sure devil… I think your site being a “non-profit” website would be a positive point. :-) But I could be wrong…

But there are other big big websites which use the name. 1 , 2 , etc…

@devil – if google thinks you are worth “suing”... you would have already made it so big by then, you should be able to handle the lawsuit buddy.

yep devil… copyrights are patents are a touchy subject. I was having a discussion the other day with a friend regarding the same subject. he values it like the bible, and I dont :-(

here’s my thought. copyrights and patents are geographic. if one applies for a patent, it’s in a particular country. it does not apply outside of the geo in which the patent has been applied for. There can be exactly the same patent granted to another individual or corporation altogether in another country… happens all the time…. What I dont like about this patent crap is that the US shoves their patents down everybody else’s throat. what about patents in india…

what i hate further more is that the US patents everything in sight:

First of all, an expert didn’t said yes ... its coming from Labnol who iirc runs a technical site, not a legal site and legal advise doesn’t come with “2 cents..” ;)

There are plenty of sites which have matching names eg… a malware site which goes by the name qoogle.com ( first alphabet is “Q” not g ) ; i doubt google can sue or shut them down.

I work in the area of security, I see phishing sites like bank0findia.com/login ( thats a “zero” in 0f ) and yet we have tough time getting these sites down.

If it was that easy to take site down; thepiratebay.com would have been shut down 500 times by now :-P …. Well, realistically speaking taking down a site depends upon how bold your host is :-)

If google gives you trouble for using orkut in name, shop for host in China or Russia :D

You not only will have to change the hosting but change the registrar, because US laws are applicable in the EU also. Take a registrar and a host in Russia, China etc, but dont come to India.
